BEFORE THE REFERENDUM, HOW DID YOUR FIRM PREPARE FOR A POTENTIAL BREXIT OUTCOME?

Delving deeply into the possible needs that would arise for the citizens of the United Kingdom if they moved to Spain (tourists, business people, retired people, individual entrepreneurs as individuals and/or their families); and attending seminars on the subject to understand the possible solutions, rather than just observing the problem and reviewing the norms that could be applied in the Spanish legal system.

WHAT WERE CLIENTS’ MAIN CONCERNS BEFORE THE REFERENDUM?

The need to obtain a residence permit to live in Spain; and the options to obtain it under the current laws for foreigners in Spain that would be the least bureaucratic or difficult.

HAVE YOU NOTICED A SIGNIFICANT SHIFT IN CLIENT NEEDS SINCE THE VOTE?

Not at all.

WHERE DO YOU ANTICIPATE THE BIGGEST PROBLEMS WILL ARISE IN CORPORATE IMMIGRATION LAW FOLLOWING BREXIT?

The decision to have two headquarters for the same company. One in the UK if necessary for their business, with staff overheads according to the new rules resulting from Brexit; and another, new headquarters in some other European city that provides them with profitability, benefits to their investment and an agile processing of work permits for displaced employees who were not European, or a headquarters that only has European contractors, thus avoiding the immigration formalities of the country.

DO YOU ANTICIPATE THERE BEING ANY BREXIT-RELATED CHALLENGES THAT WILL AFFECT THE SPANISH MARKET IN PARTICULAR?

The possible reduction of second-home buyers without a residence or work permit in Spain with medical insurance included. Retired people in the UK enjoy a lot in Spain, but if they are not given solutions they probably would not move to the Spanish coast.

HOW DO YOU ENVISAGE THE BREXIT DECISION AFFECTING FREEDOM OF MOVEMENT BETWEEN THE EU AND UK?

I believe that there will be many complaints from the population in both cases. The economic crisis has given rise to new solutions in the form of low-cost companies approaching a greater scope of clients; this has created expectations of living with more options while being limited in one of the freedoms obtained by being part of the European Union – freedom of movement – and this will cause disappointment, regardless of the age or condition of the citizen.

IN YOUR OPINION, WILL BREXIT MEAN A REDUCTION IN BUSINESSES ENTERING THE UK? WHERE DO YOU IMAGINE THIS BUSINESS WILL BE REDIRECTED?

No. The UK has been a place of business for centuries. It has a great commercial tradition. It is possible that two venues/headquarters will be established, but I cannot foresee which European city would be the chosen one.

HOW WOULD YOU SAY YOUR PRACTICE IS BETTER POSITIONED THAN OTHERS IN THE MARKET TO PROVIDE ADVICE IN RELATION TO BREXIT?

For me every customer is unique and every case deserves my attention. I study their circumstances and the rules that could affect them. I try to give an adequate solution.

IN THIS TIME OF UNCERTAINTY, WHAT IS THE BEST ADVICE THAT YOU CAN GIVE CLIENTS IN RELATION TO THEIR ACTIVITY IN THE FIELD?

Be flexible and adapt to the circumstances, and have several action plans prepared depending on the circumstances as they present themselves.
